Step by Step Guide to Sell Vehicle Privately - 2008/07/08 17:44 Dear All

Although I'm sure this info is spread throughout this forum, I was unable to determine if I'm missing something or have the story straight. Could someone please detail the steps and forms one needs to complete when selling a vehicle privately to a private buyer?

AFAIK once you've settled on the transaction details:

1. Both seller and buyer complete the Notification-of-change-of-ownership. Seller section A (personal details) and section C(vehicle details). The buyer section B (personal details).

2. The seller must give the buyer the registration document. (provided the money has been received)

3. The seller now takes the Notification-of-change-of-ownership to the Registering Authority. Once done the car is essentially legally no longer theirs, including subsequent fines etc.

4. The buyer takes the registration document to the registering authority and applies for vehicle registration on their name using Application-for-registration-and-licencing-of-motor-vehicle form.

That's what I'm pretty certain of so far.

But....where does the roadworthy fit in, I take it the buyer must do this and hand it in with the registration?

Are there any other forms one needs to complete, say, some proof that the seller has in fact sold the vehicle?

Is the sequence right, or am I exposed to fraud? E.g. Notification-of-change-of-ownership with seller, then money, then registration certificate handover?

Can the seller hand in the Notification-of-change-of-ownership at a different registering authority than the one the vehicle is currently registered at? E.g. if the car is registered in Cape Town, can one do this all in Johannesburg?

Please correct or amend this post as I couldn't find all the info in one place. If it is somewhere, please provide a link.

Your steps are indeed correct. Insist on a printed ANR - acknowledgement of receipt - proving that the NCO was indeed processed. All registration information is central, thus all authorities can view and process transactions. Your current appropriate registering authority is the one to process any of your applications, i.e. submit proof of physical address if you go to your appropriate authority the first time.
Certification of roadworthiness is not made the explicit responsibility of any person. A vehicle that changes ownership, must be certified roadworthy within 6 months before licensing, else a licence disc is not printed. A vehicle needs a licence disc to be operated on a public road. All testing stations certify vehicles roadworthy online, thus a CRW cannot be submitted as in the past (before 2008), the testing station updates the vehicle record directly. The fact that a vehicle record is not showing certification of roadworthiness cannot prevent registration and licensing of the vehicle.

Please can you explain the handing in of the NCO.

I'm the seller of a vehicle based and registered in Cape Town and would like to sell it to an party in JHB. I'll be driving the vehicle up to JHB and not return to CPT for some time. Do I have to submit the NCO here in CPT, i.e. have the buyer send me the NCO with Section B completed? I'm concerned that once I hand in the NCO, my insurance would not cover the trip up?

Is it possible for me to hand in the NCO at the buyers registration office and complete all the paperwork there?
